Terms of Service

1. Acceptance and Description of Service

Quey Quantum provides a hardware-backed True Random Number Generator (TRNG) API and related Software Development Kits (SDKs), including the Python package (quey-random) and the Node.js package (quey-random) (collectively, the "Service"). The Service distributes random numbers generated from a dedicated edge node, then routed through our Cloud Buffer architecture. By accessing or using the Service, you agree to be bound by these Terms of Service.

2. "AS-IS" Disclaimer and Assumption of Risk

While our entropy is refined using a SHA3-256 conditioning algorithm (NIST FIPS 202) to achieve high statistical uniformity, the Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis. Quey Quantum expressly disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular cryptographic purpose. Furthermore, because our Service relies on continuous physical hardware operation, we do not guarantee 100% uptime or uninterrupted access. You assume all risks associated with integrating our API into your security or scientific systems.

3. Billing, Subscriptions, and Merchant of Record

Access to our quota tiers—including the Free ($0) and Pro ($49) plans, as well as Enterprise plans on custom contracts—is processed (for paid plans) exclusively through our partner, Lemon Squeezy. Lemon Squeezy acts as our authorized Merchant of Record (MoR). You acknowledge and agree that all financial transactions, credit card processing, and international tax compliance (e.g., VAT/Sales Tax) are governed entirely by Lemon Squeezy's Terms of Service. Quey Quantum assumes no liability for payment processing errors or billing disputes.

4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Quey Quantum, its founders, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, loss of profits, data loss, or cybersecurity breaches) arising out of or related to your use or inability to use the Service.

In the event of any proven dispute, Quey Quantum’s total cumulative liability to you shall be strictly capped at the total amount you paid for the Service in the twelve (12) months immediately preceding the claim. For users on the free tier (Free plan), Quey Quantum’s maximum liability is expressly limited to zero dollars ($0.00).

5. Acceptable Use and Security Enforcement

Access to the API requires the transmission of a valid token (X-API-Key). You agree not to:

• Attempt to bypass, exploit, or exceed the quota limits managed by our database.
• Reverse-engineer, decompile, or attempt to extract the source code of our extraction software.
• Use the Service to conduct distributed denial-of-service (DDoS) attacks or deliberately overload our infrastructure.

Violation of these rules will result in the immediate and permanent revocation of your API keys without prior notice or refund.

6. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the competent courts located in Israel.
